🌙 Lunovya — Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the Lunovya mobile application and related services (collectively, the "Service"), operated by SidInTech ("we," "us," or "our"). By downloading, installing, accessing, or using Lunovya, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy, which is incorporated by reference. These Terms form a binding agreement between you and SidInTech.

2. Eligibility

You must be at least 18 years old to use Lunovya. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The Service is not intended for, and may not be used by, anyone under 18. If we learn that we have collected information from a person under 18, we will delete it.

3. Description of the Service

Lunovya helps you record and understand your menstrual cycle and fertility signals. Features may include cycle and ovulation tracking, daily logging of symptoms and fertility indicators, predictions and statistics, AI-generated educational guidance and insights, reminders, an optional limited partner-sharing feature, and data export. Features may change, be added, or be removed over time.

4. Medical Disclaimer — No Medical Advice

Lunovya provides information for general wellness, informational, and educational purposes only. It is not a medical device and does not provide medical, clinical, or professional health advice.

• Cycle predictions, fertile-window estimates, ovulation detection, and statistics are estimates based on the data you enter and may be inaccurate.
• AI-generated chat responses and insights are automated, may contain errors, and are not a substitute for advice from a licensed healthcare professional.
• Lunovya must not be used as a form of birth control or contraception, nor relied upon to prevent or achieve pregnancy.
• Never disregard, avoid, or delay seeking professional medical advice because of something you read or received within the Service.
• In a medical emergency, contact your local emergency services immediately.

You are solely responsible for any decisions or actions you take based on the Service, and you use it at your own risk.

5. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it up to date.
• You must notify us promptly of any unauthorized use of your account.
• You may use Apple Sign-In or email/password authentication as offered in the app.

6. Subscriptions, Billing & Auto-Renewal

Certain features of Lunovya require a paid auto-renewable subscription ("Premium"). Subscriptions are sold and processed through the Apple App Store, and your purchase is subject to Apple's terms in addition to these Terms.

• Billing: Payment is charged to your Apple ID account upon confirmation of purchase.
• Auto-renewal: Your subscription automatically renews for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal charge: Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
• Managing & canceling: You can manage or cancel your subscription, and turn off auto-renewal, in your device's App Store account settings after purchase.
• Free trials / introductory offers: Where offered, any unused portion of a free trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription converts to a paid subscription at the stated price.
• Price changes: We may change subscription prices. Changes apply to future billing periods and, where required, only after notice and your consent in accordance with App Store rules.
• Refunds: Purchases are handled by Apple and are subject to Apple's refund policies. We do not directly process payments or issue refunds; requests must be made to Apple.

7. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Lunovya for your own personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app, except where permitted by law
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or other users' accounts or data
• Use automated means (bots, scrapers) to access or collect data from the Service
• Upload content that is unlawful, infringing, harmful, or that you do not have the right to share
• Misuse the AI features, including attempts to generate harmful, abusive, or unlawful content

9. Your Content

You retain ownership of the data and content you log in Lunovya (such as cycle data, symptoms, notes, and photos). You grant us a limited license to host, store, process, and display this content solely to operate and provide the Service to you, as described in our Privacy Policy. You are responsible for the accuracy and legality of the content you provide.

10. Partner Sharing

If you choose to use the partner-sharing feature, you authorize us to share a limited cycle summary with the partner you invite, as described in our Privacy Policy. You are responsible for choosing whom you invite. You may unlink a partner at any time, which immediately revokes their access.

11. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the "Lunovya" name, is owned by SidInTech and protected by intellectual property laws. Except for the limited license granted to you, no rights are transferred to you. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

12. Third-Party Services

The Service relies on third-party providers (including Google Firebase, OpenAI, RevenueCat, and Apple) to function. Your use of features that depend on these providers may also be subject to their terms and privacy policies. We are not responsible for the acts, omissions, or content of third parties.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that predictions, insights, or AI outputs will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, SidInTech and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Service, including any reliance on cycle predictions, fertility estimates, or AI-generated content.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the greater of the amount you paid us for the Service in the twelve (12) months preceding the claim, or USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless SidInTech from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Termination

You may stop using the Service and delete your account at any time from the app's Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

17. Changes to These Terms

We may update these Terms from time to time. We will indicate the date of the latest revision above and, for material changes, provide notice through the app or other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles. Subject to applicable mandatory consumer-protection laws of your country of residence, any disputes shall be resolved by the competent courts of Türkiye. This does not deprive you of any protection afforded by mandatory laws in your jurisdiction.

19. Apple App Store — Additional Terms

The following terms apply to your use of Lunovya obtained through the Apple App Store. In the event of any conflict between these Terms and Apple's Licensed Application End User License Agreement (EULA), Apple's terms govern with respect to your use on Apple devices.

• These Terms are between you and SidInTech only, and not with Apple. Apple is not responsible for the application or its content.
• Apple has no obligation to provide maintenance or support for the application.
• In the event the application fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the application.
• Apple is not responsible for addressing any claims by you or any third party relating to the application, including product-liability, regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
