1. Acceptance of Terms
By downloading, installing, or using Hotify ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.
2. Description of Service
Hotify is a facial wellness application that uses artificial intelligence to analyze facial features and provide:
- Overall wellness scores and sub-metric ratings
- Personalized skincare and wellness routines
- Progress tracking over time
The App is for informational and entertainment purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
3. Eligibility
You must be at least 13 years old to use Hotify. By using the App, you represent that you meet this age requirement.
4. User Accounts
- Accounts are created anonymously. You are responsible for maintaining access to your device, as account recovery may not be possible.
- You are responsible for all activity that occurs under your account.
5. Subscriptions and Payments
5.1 Free Tier
- Limited to one facial scan per day.
- Access to basic wellness scores.
5.2 Hotify Pro (Paid Subscription)
- Unlimited scans
- Detailed metric breakdowns
- Personalized routines
- Progress tracking
5.3 Billing
- Subscriptions are billed through Apple's App Store (In-App Purchase).
- Available plans: Weekly and Monthly.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple ID Account Settings.
5.4 Free Trial
- If offered, the free trial period is specified at the time of purchase.
- If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
5.5 Refunds
Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload content that is illegal, harmful, or violates the rights of others
- Attempt to reverse engineer, decompile, or disassemble the App
- Attempt to circumvent subscription restrictions or security measures
- Use the App to harass, bully, or harm others
- Upload photos of other individuals without their consent
- Use automated systems or bots to access the App
7. Intellectual Property
- All content, features, and functionality of Hotify (including but not limited to text, graphics, logos, icons, algorithms, and software) are owned by SidinTech and are protected by intellectual property laws.
- You retain ownership of photos you upload but grant us a limited license to process them for the purpose of providing the service.
- AI-generated analysis results, routines, and recommendations are provided for your personal use only and may not be redistributed commercially.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- We do not guarantee the accuracy, reliability, or completeness of any facial analysis, score, or recommendation.
- Results are generated by AI and should not be considered professional medical, dermatological, or cosmetic advice.
- We do not warrant that the App will be uninterrupted, error-free, or free of viruses.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIDINTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
- Your use of or inability to use the App
- Any decisions made based on analysis results or recommendations
- Unauthorized access to or alteration of your data
- Any third-party service failures
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless SidinTech from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the App.
11. Data Deletion
You may delete all your data at any time through Settings > Delete All Data. This action is permanent and cannot be undone.
12. Modifications to the Service
We reserve the right to:
- Modify, suspend, or discontinue the App (or any part of it) at any time
- Change subscription pricing with notice to existing subscribers
- Update these Terms at any time
Continued use after changes constitutes acceptance.
13. Termination
We may terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or third parties.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law provisions.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
